
KOCHI: In a significant legal victory for the state government, the Kerala High Court cleared the path for the transfer of Director of Health Services (DHS) Dr. K.J. Reena, vacating an earlier stay order issued by the Kerala Administrative Tribunal (KAT).
A division bench comprising Justice Anil K. Narendran and Justice Muralikrishnan passed the verdict after hearing detailed arguments from both sides, effectively allowing the government's administrative reshuffle to take effect.
The state government had approached the High Court to challenge the KAT's interim stay on the transfer order, setting off a sharp legal debate over administrative authority. Dr. Reena’s counsel argued that her sudden removal from the top public health post was arbitrary, procedurally flawed, and legally unsustainable.
However, the Additional Advocate General, representing the state, strongly countered these claims by asserting that the transfer adhered strictly to all prescribed administrative protocols. The government further clarified that the move was not a punitive demotion, as Dr. Reena was being repositioned into an equivalent directorial cadre at a state laboratory. Finding merit in the state’s arguments, the division bench ultimately validated the government's position and vacated the tribunal's stay.
The administrative shake-up has triggered a political storm, with the opposition slamming the government for removing the state’s top health official amidst a worrying spike in communicable diseases across Kerala. Opposition leaders termed the mid-crisis transfer a "vindictive measure" that could cripple the state's public health machinery.
However, Health Minister K. Muraleedharan strongly defended the decision, stating that the administrative action was warranted because the official was "functioning against the system." Health Department officials alleged that Dr. Reena had failed to consult the government on critical policy matters and operational decisions.
Dr. Reena, who was appointed as the DHS during the Left Democratic Front (LDF) government's tenure, has been reassigned as the Director of the Ernakulam Public Health Laboratory.
Consequent to her transfer, Dr. V. Meenakshi, currently the Additional Director (Family Welfare), has been given official charge as the new Director of Health Services.
